What a major loss claim has to cover

A big loss is rarely one check. Most homeowners policies split it into parts, each with its own limit and rules, and an adjuster can pay one part fairly and short another.

Before you signA release, or a check described as full and final payment, can affect what you can still recover. Send it to us first. The review is free.
  • The house itselfFraming, roof, walls, wiring and finishes, priced to repair or rebuild what you had.
  • Other structuresDetached garages, fences and sheds, under their own limit.
  • Your belongingsFurniture, clothes and everything else, usually backed by an inventory the insurer questions line by line.
  • Living costsA hotel or rental, extra meals and mileage while you can't live at home, if your policy includes this coverage.
  • Code upgrades and debrisSome policies pay to bring rebuilt work up to current code and to haul away what's left; some cap these separately.
  • Depreciation held backReplacement-cost policies often pay the depreciated amount first and the rest after repairs, and deadlines can apply.

What we handle

Major losses we handle in North Carolina

From our Greensboro office, we handle major losses across North Carolina, from Charlotte to Wilmington to the mountains, where hard freezes split pipes and storm-weakened trees still come down on homes.

House fire and smoke

Insurers dispute the cause, how far smoke and soot traveled, the contents list and the cost to rebuild. We check each one against the policy and the evidence.

Burst and frozen pipes

A sudden burst is usually covered. The fight is often over whether the insurer can call it a slow leak, wear and tear, or a failure to keep the heat on. We read the exclusion and push back where it doesn't fit.

A tree or limb through the roof

Once a tree opens the roof, water and framing damage follow. Insurers may call the tree rotten or the damage old, and policies often limit tree removal separately from the repair.

A vehicle into your home

A car or truck that hits your house is a property claim, and we handle those. Your homeowners policy may pay for the house even when the driver's insurer is involved, and the two carriers can point at each other while repairs wait. We handle home and business property insurance claims. We don't handle car or auto accident claims.

Total loss and structural collapse

When a home is destroyed or can't be lived in, the questions are the policy limits, what it really costs to rebuild today, and how long living costs will be paid. We make sure every coverage part is counted before you settle.

North Carolina rules on how insurers handle claims

North Carolina's Unfair Claim Settlement Practices statute, N.C. Gen. Stat. § 58-63-15, lists the conduct insurers must avoid. Conduct found to be unfair or deceptive may also support a claim under § 75-1.1, the state's unfair and deceptive trade practices law, which may allow treble damages and attorney's fees.

How it works

Four steps from a denied NC claim to a fair settlement

Most North Carolina homeowners are surprised how little they have to do once an attorney is involved — even with carriers used to taking advantage of policyholders without representation.

01

You call us

Free, confidential conversation. Bring your policy and any letters from the insurer if you have them.

02

We investigate

We send our own adjusters and engineers to document the real scope of damage, often the moment things change.

03

We negotiate

We send the carrier a documented demand citing the § 58-63-15(11) violations that apply. Many cases resolve here — once a carrier sees a § 75-1.1 treble-damages exposure laid out, the offer changes.

04

We litigate if needed

If they still won't pay fairly, we file suit in NC state court, federal court, or — for complex commercial property disputes — the NC Business Court, with the resources to take it all the way.

Common questions

What homeowners ask us first

What counts as a major loss?

Damage that makes a big part of your home unusable, or a claim with several coverage parts in play: the structure, your belongings and living costs. House fires, burst pipes, trees through the roof, vehicles into the home and total losses are the usual examples. If you're not sure, send it to us.

The insurer already paid part of my claim. Can you still help?

Often, yes. A first payment can be based on an early estimate. We compare it with the policy and the actual damage and go after what's missing.

I signed paperwork with a cleanup or restoration company. Is that a problem?

Not necessarily. Many homeowners sign an authorization so cleanup can start. Tell us what you signed and we'll review it with your claim.

Does my homeowners policy cover a car that hit my house?

Damage to the home from a vehicle is usually a covered cause of loss, and the driver's insurer may also owe. Every policy is different, so we read yours. We handle the property claim for your home, not the car or auto accident claim.

What does it cost?

No fee unless we win. We walk you through exactly how fees and case costs work before you sign anything. The first review is free.

Why do you ask for a rough estimate of the damage?

It helps us route your claim to the right attorney quickly. A best guess is fine, and "Not sure yet" is always an option.
